论金砖国家能源合作的治理机制构建

　　21世纪是能源的世纪,能源问题是关乎一个国家的安全与发展的重要问题。当前,随着经济全球化的广泛发展,国际能源合作的广度和深度都不断扩展,国际能源合作出现了一些新的形式,主要有贸易式合作、协议式合作以及投资式合作。为了进一步促进国际合作的发展,在全球以及区域范围内也涌现出一些能源合作的法律机制,全球性能源组织的国际法律机制,例如国际能源署、石油输出国组织、能源宪章组织、国际能源论坛等;区域性的能源国际法律机制包括欧盟的国际能源法律机制、上海合作组织能源合作机制等等。对金砖国家来说,金砖国家作为新兴国家崛起的代表,能源资源各具特色,能源发展需求极为相似,具备较好的合作基础。此外,能源合作正逐渐成为金砖各国合作的一个主要内容,构建能源合作的法律机制也成为部分金砖国家的诉求。因此,随着金砖国家能源合作的深入合作的内容也将会发生深刻的变化。要保证金砖国l家能源合作能够有序规范运行,就有必要借鉴国际能源合作法律机制形成之经验,构建符合金砖国家能源特点和要求的能源合作法律机制框架,从制度上保障金砖国家能源合作的进一步发展。本文采取案例研究的方式,对五个主要的国际和区域能源合作的法律机制进行研究,包括...
