汉语立法文本英译中元功能意义参数偏移的研究

随着中国经济迅速发展,跨境交往日益频繁。为了稳定社会秩序,降低不断增加的涉外犯罪率,面向外国人特别是外国商人普及中国的法律法规也显得日益重要。现实中,长久以来受西方法治思维影响的外国人对中国的法律还不甚了解,因为在中国,诸多法律法规要么缺乏对应的英文,要么缺乏统一准确的英文译本。实践中甚至有很多外国人反应在中国合法权益受到侵害时,不清楚向哪个部门寻求法律帮助来维权。立法是依法治国的第一步,当中国正在如火如荼的修改各种法律法规以更好地服务经济和社会发展全局的时候,立法文件相应的英文译本建设却滞后了。伴随着中国进一步融入国际社会,中国法律法规翻译的建设应当提上日程。本研究选取了于2012年全国人大修订的《中华人民共和国刑事诉讼法》(以下简称“《刑诉》”)为研究对象,该部法律属于程序法,详细地阐明了有关刑事犯罪从立案,侦查到审判执行等一系列司法程序的环节。目前这一立法文件还未有官方统一的英文译本。本研究从系统功能语言学元语言功能理论出发,发现《刑诉》英译文中元功能意义参数偏移这一现象,期望可以扩大以往的翻译转移研究,在基于这些偏移是否实现了中国立法文本翻译交际目的的基础上对这些偏移做出是正面...
